Terms and Conditions: “BEND BALANCE TRAIN”

1. Ownership and Binding of Terms
This website is owned and operated by Victoria Kouzz. These Terms set forth the conditions under which visitors may use the website and the services offered, including virtual and in-person classes in contortion, flexibility, handstands, gymnastics, and acrobatics. By accessing or using this website, you approve that you have read, understood, and agree to be bound by these Terms.
2. Who Can Use the Website
In order to use the website and/or receive services, you must be at least 18 years of age (or the legal age of majority in your jurisdiction) or be the Parent or Legal Guardian of a minor Participant. You must possess the legal authority to enter into these Terms as a binding agreement.
3. Key Commercial Terms
When purchasing a class or package:
• (i) You are responsible for reading the full class description before purchase.
• (ii) You enter into a legally binding contract when you complete the check-out payment process.
• (iii) Prices for services are listed on the website; we reserve the right to change prices or correct pricing errors at any time.
4. Cancellation, Refund, and Lateness Policy
“BEND BALANCE TRAIN” operates with a strict twenty-four (24) hour cancellation policy.
• Rescheduling: You must reschedule or cancel via your website account ("My Bookings") or via email at trainwithvkouzz@gmail.com at least 24 hours in advance.
• No-Show/Late Cancellation: Failure to notify us at least 24 hours in advance results in forfeiture of the class. No credit or refund will be issued.
• Lateness: If a student is late, the lesson will finish at the originally scheduled time. No makeup time or class will be provided.
• Refunds: Refunds are not available under any circumstance.
5. Low Enrolment Policy
• 3+ Students: Class runs as scheduled.
• 2 Students: Class runs but will be shorter in length.
• 1 Student: The student will be offered a shorter private session or the option to reschedule.
• 0 Students: Classes with no enrolment 24 hours in advance will be removed from the schedule.
6. Termination of Account
“BEND BALANCE TRAIN” retains the right to suspend or cancel a user account or release a student at any time, for cause, including:
• Misconduct (aggressive behavior, harassment, slander, bullying, or defamatory statements towards Victoria Kouzz or Fiodor Martea).
• Failure to comply with these Terms and Conditions or the Safety & Liability Waiver.
7. Indemnification and Liability
You agree to indemnify and hold Victoria Kouzz and Fiodor Martea harmless from any demands, loss, liability, claims, or expenses (including legal fees), made against them by any third party due to, or arising out of, your use of the website or any of the services offered. Your participation is further subject to the terms of our Release of Liability, Waiver of Claims and Indemnity Agreement.
8. Promotional Emails and Content
By creating an account, you agree to receive promotional messages and materials via email, social media, or text. You may opt-out of these communications at any time by notifying us.
9. Privacy Policy
• Information Gathering: We gather information to provide services and process payments. We do not sell your data.
• Legal Disclosure: We may disclose information if required by law or to protect the rights and safety of “BEND BALANCE TRAIN,” its owners, or other users.
• Minors: If you are 17 or younger, do not submit personal information without a parent. While we coach minors, accounts must be managed by a Parent or Legal Guardian. We will delete any account found to be created by a minor without parental consent.
10. Right to Change and Modify Terms
We reserve the right to modify these terms at our sole discretion. Continued use of the website after a material change constitutes acceptance of the new Terms.
